PARTICIPANT TERMS AND CONDITIONS
NOTICE TO PARTICIPANTS
The following Terms & Conditions form the basis of your contract with LIVEBEYOND LTD. (“The Company”, "we", "us" and "our"). Please read them carefully as upon acceptance of your application to one of the LiveBeyond Experiences, these Terms & Conditions govern your participation in our program, constitute a binding contract between both parties, and set out our respective rights and obligations.
LIVEBEYOND’s responsibilities and liabilities are expressly limited as provided in these terms and conditions. By accepting to participate in one of our Experiences, we are entitled to assume that you have read these conditions and agree to them. Your attention is especially directed to the provisions of these Terms & Conditions limiting LIVEBEYOND LTD.’s responsibilities and liabilities for your illness, injury or death, as well as for damages, claims related to carriers, housing, cancellations, changes, baggage and personal property, and your rights to sue or arbitrate in the event you cancel your reservation or leave the experience early regardless of cause.
By accepting to join any LiveBeyond Experience, you certify that you have read, understand and accept these Terms & Conditions as an integral part of your agreement and contract with us. All references in these conditions to "trip", "Experience", or "contract" mean such LiveBeyond Experience arrangements unless otherwise stated.
RESPONSIBILITY
LIVEBEYOND LTD. is a lifestyle design company, which organises immersive productivity and wellbeing experiences for remote workers. The Company seeks to help participants build positive work & lifestyle habits for improving performance in location-flexible workplaces. In such capacity, LIVEBEYOND LTD. organises and negotiates the provision of products and services delivered by independent third parties, whose employees, facilities, vehicles, as well as the products and services themselves, are not subject to LIVEBEYOND LTD’s supervision and control, and hence The Company is not responsible for their action or inaction.
All services provided in connection with the Experience, including but not limited to housing and transportation are provided, owned and operated by independent third parties. LIVEBEYOND LTD. acts only as an arranger for transportation carrier, ground operator, accommodation provider or other suppliers of services connected with our Experiences (“other providers”), and the other providers are the sole responsible and liable for their respective products and services.
In Experiences where LIVEBEYOND LTD. partners with Wim Hof Method (“WHM”) certified instructors for the delivery of the WHM Fundamentals Course, it is your personal responsibility to opt-in on the course. By accepting to join the course, you certify that you have read and understood the potential risks related to practicing breathwork and cold exposure, that you participate voluntarily and entirely at your own risk, and that you shall not hold LIVEBEYOND LTD. liable for any damages and/or injury resulting from participation in the WHM course.
In connection with the Experience and its associated activities before, during and after, The Company shall not be liable for participants’ emotional distress, mental suffering or psychological injury of any kind, under any circumstances. The responsibility of LIVEBEYOND LTD. in connection with the Experience is strictly limited. The Company makes no warranty regarding the suitability, safety, insurance or other aspects of any of the independent third party providers, and hence is not liable for any claim for loss, damage, injury, death, misrepresentation, delay, inconvenience or disappointment, arising from any action or inaction by any other provider, including but not limited to any negligent or willful act or failure to act of any other provider or of any other third party. You assume the risk of LIVEBEYOND LTD.’s negligence.
You agree to assume responsibility for your own safety, and we cannot guarantee your safety at any time. Local conditions, including infrastructure, road conditions, medical care, safety and security, may differ significantly from those found in your home country. At any given moment there are also likely to be “trouble spots” in the world in terms of war, terrorism, crime, Acts of God, civil commotions, labor trouble, and/or other potential sources of harm. We strongly recommend that you obtain and consider information related to local risks, risk perception and safety conditions when making travel decisions. We assume no responsibility for gathering such information or providing it to you.
LIVEBEYOND LTD., its managers, members, employees, and representatives, shall not be held liable for any damage to, or loss of, property or injury to, or death of, persons suffered during a LIVEBEYOND Experience, whether or not occasioned directly or indirectly by an act or omission of The Company or any other provider, including but not limited to any latent or undisclosed defect in any aircraft, watercraft, vehicle, hotel, hostel, apartment, villa or other service or property operated or provided by any other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the other providers, or any laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by Acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. The participant waives any claim against LIVEBEYOND LTD. and/or its team members for any such loss, damage, injury, or death.
YOUR BEHAVIOUR & OUR RIGHT TO EXPEL
You must comply with the instructions of the Experience Leader in all matters related to the safety of the group. Your Experience Leader has the right to ask any participant to withdraw from an Experience if it is considered necessary for the wellbeing or safety of that person or other members of the group. LIVEBEYOND LTD. reserves the right in their sole discretion to remove any participant from an Experience at any time during the trip. If we remove you from an Experience in progress, you will not be entitled to any refund, compensation or credit and you will be responsible for your travel costs to return home or go to your next destination.
ADDITIONAL RISKS
Additional risks and dangers may arise including, but not limited to, hazards of traveling in undeveloped areas, hazards of travel by boat, train, automobile, aircraft and other means of conveyance, animal interactions, forces of nature, political unrest, other unrest, hazardous local customs and practices, differing levels of sanitation, differing standards of safety, risks associated with water, food, plants, insects and differing animal regulation, accident or illness in areas lacking means of rapid evacuation or medical facilities, and acts of national and local governments and unrest and acts of others against governments. These risks are not an exhaustive list but are examples of many kinds of risks. You are voluntarily participating in these activities by accepting to participate in a LIVEBEYOND Experience, with the knowledge that there may be significant dangers involved, and you hereby agree to accept any and all risks. As lawful consideration for the agreement with LIVEBEYOND LTD, you agree you will not make a claim against The Company or any of its employees, members, or Directors, or any of its personnel, or sue for bodily injury, emotional trauma, death, property loss or damage or other loss, cost or expense, however caused, as a result of or related to your participating in the Experience. You release LIVEBEYOND LTD. and its personnel from any and all claims, known or unknown, arising from participating in an Experience
TERMS AND CONDITIONS
Included in Fee: accommodation; 24/7 access to common areas; 24hr internet access and backup data plans; local SIM card (if requested by participant); dedicated Experience leader in every location; guided workshops, talks, guest speakers, facilitated trainings and peer-to-peer sessions; welcome pack; access to alumni community; welcome and closing event; daily breakfast (where indicated); airport pickup (where indicated); morning activities like fitness, meditation and/or yoga sessions, or similar; and miscellaneous activities and events.
Not Included in Fee: flights in and out of the destination of choice; travel insurance; adventures outside of our planned activities; weekend trips you decide to do during the program; alcohol; meals (other than breakfast); visa-related expenses; medical expenses; and any other personal expenses such as laundry, telephone calls (not covered by your local SIM), or any other items not specifically noted as included in these Terms & Conditions.
Health: By registering for an LIVEBEYOND Experience, you certify that you do not have any mental, physical, or other condition or disability that would create a hazard for yourself or that of the group.
Visas: It is your responsibility to research the visa process and requirements based on the chosen Experience destination.
Transfer of Booking: If you or any member of your party is prevented from travelling, that person(s) may transfer their place to someone else, subject to the following conditions:
that person is introduced by you and satisfies all the conditions applicable to the Experience;
that person follows all the steps in LIVEBEYOND LTD.’s application process, and LIVEBEYOND LTD. representatives have enough time to interview, deliberate and formally accept the new applicant(s)
LIVEBEYOND LTD. is notified not less than 14 days before departure;
you pay any outstanding balance payment, as well as any additional fees, charges or other costs arising from the transfer; and
the transferee agrees to these booking terms & conditions and all other terms of the contract between us.
you and the transferee remain jointly and severally liable for payment of all sums. If you are unable to find a replacement, cancellation charges will apply as set in these Terms & Conditions.
Cancellations by you: Upon acceptance to one of the LIVEBEYOND Experiences, a 50% deposit is required to secure your place, with the remaining 50% to be paid latest at 1 month prior to the experience. Limited refundability will apply. If cancellation occurs +3 months before the commencement of the experience, you will be entitled to a 100% refund of the value paid. If cancellation occurs +2 months before the commencement of the experience, you will be entitled to a 50% refund of the value paid. No refunds can be provided thereafter for cancellations within 2 months before the commencement of the experience. Payments shall be made via online payment, via the link provided in your Acceptance email.
Experience cancellations by us: LIVEBEYOND reserves the right to cancel any potential Experience because of inadequate or insufficient enrollment, or due to any other reason that makes the trip economically infeasible to operate, or because of good-faith concerns with respect to the safety, health, or welfare of the participants. If a program is canceled prior to departure, LIVEBEYOND LTD. will provide participants with a full refund of monies paid to The Company; except in the event that the cancellation is due to an event of force majeure (see below). If LIVEBEYOND LTD. cancels a trip in progress, participants will receive a prorated refund based on the number of days not completed on the Experience.
Force Majeure: Except where otherwise expressly stated, we will not be liable or pay any compensation if our contractual obligations to you are affected by “Force Majeure”. For the purposes of these Terms & Conditions, Force Majeure means any event beyond our own or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid.
Changes in Itinerary: LIVEBEYOND LTD. reserves the right, without penalty, to make changes in the published itinerary whenever, in their judgment, conditions warrant or if they deem it necessary for the comfort, convenience, or safety of participants.
Illegal Activity: All participants are expected to abide by the laws in each country visited. If a participant at any point during the program performs any illegal activity, LIVEBEYOND LTD. is not responsible for legal ramifications of that action.
APPLICABLE LAWS AND JURISDICTION
No matter where you live, your booking with us is accepted under English law and the Courts of England and Wales shall have the exclusive jurisdiction to decide on any disputes between us.
